Can someone sign on my behalf?
Yes, it is completely legal. Spanish Civil Code allows a third party to act as a verbal agent in a purchase when the buyer cannot be present due to urgency, distance, or commitments.
How does it work?
- Verbal Mandate (Art. 1710 CC): A representative can sign on your behalf declaring to be your "verbal agent"
- Later Ratification: For full registry effect, you must ratify the transaction before a notary when convenient
- Total Security: The property is already in escrow β no risk to the asset, only your signature is needed
Preferred Option: Notarial Power of Attorney
If you prefer to avoid later ratification, you can grant a special power of attorney:
- At the Spanish Consulate in your country of residence
- Before a local notary with subsequent Apostille (Hague Convention)
- The power is sent to Spain and a Spanish notary elevates it to public deed
